1.      Booking and Payment

Upon booking, the Photographer will reserve the time and date agreed upon, and will not make other reservations for that time and date. A deposit of £25.00 is to be paid at the time of booking to secure your Photography Session. Client agrees if the deposit is not paid at the time of booking, the Photographer cannot guarantee to your session booking. The remaining balance of your session fee is due at the time of your session and can be paid via cash/card.

2.      Cancellation/ Postponement  

If the Client cancels the Photography Session, the deposit of £25.00 is non-refundable. Should the cancelled appointment turn out to be a postponement, then, subject to the Photographers availability, all monies paid may be applied to the new appointment. This is limited to one postpoement only, if the second booking is cancelled the deposit will be lost and a new deposit must be placed to book a new date.

3.      Limit of Liability

In the unlikely event that the Photographer is injured, becomes too ill, or has an emergency that prevents them from doing the session on the agreed date/time, the Photographer will make arrangements to re-schedule the portrait session. If a suitable day for reschedule is not agreed upon, the Client agrees that responsibility and liability of the Photographer to the Client is limited to the return of all payments received. In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the Photographer’s control, including but not limited to camera, hard drive, or equipment malfunction, the Photographer’s liability is limited to the return of all payments received.

4.      Completion Schedule

Digital processing takes approximately 1-2 weeks, at which time the online gallery will be e-mailed to the client. Once image choices have been made any digitals/products will be ready for collection or posted out depending on client’s preference within 2-3 weeks.

5.      Digital Negatives, Prints and Copyright

The photographs, digital negatives or prints produced by the Photographer, are protected by International Copyright Law (all rights reserved) and the Photographer retains the copyright to all photos and images produced. Any digital images included in the session fee or additional digitals purchased by the Client can be reproduced in any manner they like for sharing and enjoyment of friends and relatives. However, the Client must not reproduce any images for publishing or selling for profit. Printed images are not to be scanned, this is against copyright law. 

6.      Mobile Phones

Mobile phones are allowed in the studio, but no photographs are to be taken except by the photographer themself during the session, unless express permission is given for behind the scene shots/video.

7.      Refunds

Any issues with products such as prints/wall art must be made known to the photographer within 7 days, as they are a personalised item they are non-refundable, however returns in exchange for the same product can be made as long as the photographer is made aware within the 7 day time frame. Due to the nature of digital images these are completely non-refundable.

8.     Online Galleries

Your online gallery will be e-mailed for you to make your selection of images, this is purely for viewing the images and will be watermarked. The client agrees not to copy/save or screen shot any images from the online viewing gallery. Should the client take any images from the online gallery in such manner they will be charged in full for the cost of the images as digital form.

Cookies.

When someone visits www.GwytherPhotography.com it will collect cookies, this is data for website analytics.
We use Google Analytics, to collect standard internet log information and details of visitor behaviour patterns. We do this to find out things such as the number of visitors to the various parts of the site. This information is only processed in a way which does not identify anyone. We do not make, and do not allow Google to make, any attempt to find out the identities of those visiting our website.

Contact Forms.

I have a contact form that appears on one of the pages on this website. If you complete this form I will only use your data to reply to your enquiry.
These details are only stored long enough to allow me to reply to your enquiry.
If I have an email conversation with you as a result of your enquiry then I will add your email address to my email address book in order to continue to communicate with you. I will not add your details to a mailing list or share them with any third parties.

Other Information & Data.

Gwyther Photography only collects your data i.e Email address, name etc. when working with you. I like to store your images for as long as possible incase you should ever come back to me with a need for them, however you are welcome to ask me at any point, what data I have, how I keep it and I will be happy to delete it on request.

Disclousers of your personal data.
I may have to share your personal data with the parties set out below:

* Service providers who provide IT and system administration services.
* Professional advisers including lawyers, bankers, and insurers
* Government bodies that require us to report processing activities.

We require all third parties to whom we transfer your data to respect the security of your personal data and to treat it in accordance with the law. We only allow such third parties to process your personal data for specified purposes and in accordance with our instructions.

Data Retention.
 
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
When deciding what the correct time is to keep the data for we look at its amount, nature and sensitivity, potential risk of harm from unauthorised use or disclosure, the processing purposes, if these can be achieved by other means and legal requirements.
For tax purposes the law requires us to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they stop being customers.
